By accessing or using QRCarShop.com ("the Platform"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this Platform.

2. Description of Service

QRCarShop.com is an online marketplace that connects vehicle sellers with potential buyers. We provide:

• Vehicle listing creation and management tools
• QR code generation for printed vehicle advertisements
• Analytics tracking for listing performance
• Payment processing for premium subscription services

Important: QRCarShop.com is a platform service only. We do not sell vehicles, verify vehicle conditions, participate in transactions, or act as an agent for buyers or sellers.

3. Account Types and Registration

3.1 Account Types

We offer two types of accounts:

• Individual Account (Free): Allows one active listing at a time
• Dealer Account ($79/month): Allows up to 100 active listings with a 60-day free trial

3.2 Registration Requirements

To create an account, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Have the legal right to sell any vehicles you list

3.3 Account Security

You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use or security breach.

4. Listing Requirements and Prohibited Content

4.1 Listing Standards

All vehicle listings must:

• Contain accurate and truthful information
• Include clear, unaltered photos of the actual vehicle
• Disclose known defects, damage, or issues
• List the correct VIN (Vehicle Identification Number)
• State the accurate mileage, year, make, and model

4.2 Prohibited Activities

You may NOT use QRCarShop.com to:

• Post fraudulent, misleading, or deceptive listings
• Sell stolen vehicles or vehicles with liens without disclosure
• List vehicles you do not own or have authority to sell
• Use false or misleading photos
• Engage in bait-and-switch tactics
• Violate any local, state, or federal laws
• Harass, abuse, or harm other users
• Attempt to manipulate or interfere with Platform functionality
• Scrape, data mine, or use automated tools without permission

5. Payment Terms (Dealer Subscriptions)

5.1 Subscription Pricing

Dealer accounts cost $79.00 per month, billed automatically via Stripe. New subscriptions include a 60-day free trial period.

5.2 Billing and Renewal

• Subscriptions automatically renew monthly unless canceled
• You will be charged on the same day each month
• Price changes will be communicated 30 days in advance
• All payments are processed securely through Stripe

5.3 Cancellation and Refunds

• You may cancel your subscription at any time through your account dashboard or the Stripe Customer Portal
• Cancellations take effect at the end of the current billing period
• No refunds are provided for partial months
• Upon cancellation, your listings will be limited to 1 active listing (Individual tier)
• Free trial cancellations will not be charged

5.4 Payment Disputes

If you believe you were incorrectly charged, contact us at support@qrcarshop.com within 30 days. We will investigate and resolve legitimate billing errors.

6. QR Code Usage and Intellectual Property

6.1 QR Code License

We grant you a non-exclusive, non-transferable license to use the QR codes generated for your listings solely for the purpose of advertising your vehicles. You may:

• Print and display QR codes on your vehicles
• Share QR codes in your personal advertisements
• Use QR codes on social media and classified sites

6.2 Your Content

You retain ownership of all photos, descriptions, and content you upload. By posting content, you grant QRCarShop.com a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content for the purpose of operating the Platform.

6.3 Platform Intellectual Property

The QRCarShop.com name, logo, design, software, and all Platform features are owned by us and protected by copyright and trademark laws.

7. Analytics and Location Tracking

Our Platform collects analytics data to help you understand listing performance, including:

• Page views and QR code scans
• Geographic location data (with user consent for GPS, or via IP address)
• Device types and referral sources
• User interaction with photos and listing details

8. Disclaimer of Warranties

QRCarShop.com is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee:

• The accuracy, completeness, or reliability of listings
• That the Platform will be error-free or uninterrupted
• That vehicles listed are as described
• The conduct or identity of users
• Successful sale outcomes

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• QRCarShop.com is not liable for any indirect, incidental, special, or consequential damages
• Our total liability for any claim shall not exceed the amount you paid us in the past 12 months (or $100 if greater)
• We are not responsible for disputes between buyers and sellers
• We are not liable for vehicle condition, fraud, misrepresentation, or failed transactions

10. Indemnification

You agree to indemnify and hold harmless QRCarShop.com, its owners, employees, and affiliates from any claims, damages, or expenses arising from:

• Your use of the Platform
• Your listings or content
• Your violation of these Terms
• Your violation of any rights of another party

11. Account Termination

11.1 Termination by You

You may close your account at any time by contacting support@qrcarshop.com or through your account settings.

11.2 Termination by Us

We reserve the right to suspend or terminate accounts that:

• Violate these Terms
• Post fraudulent or prohibited content
• Engage in abusive behavior
• Remain inactive for extended periods (180+ days)

We will make reasonable efforts to notify you before termination, but reserve the right to terminate immediately in cases of serious violations.

12. Modifications to Terms

We may update these Terms from time to time. We will notify users of significant changes via email or Platform notification. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law provisions.

Any disputes shall be resolved through:

2. Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration under the American Arbitration Association rules
3. Jurisdiction: Any litigation must be brought in state or federal courts in Georgia

14. Miscellaneous

14.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and QRCarShop.com.

14.2 Severability

If any provision of these Terms is found to be invalid, the remaining provisions will remain in effect.

14.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

14.4 Assignment
